Commission Terms of Service
1. I do not consent to my artwork being used in any form of AI generated content. This includes, but is not limited to: using my artwork to train an AI model, using AI to edit or "finish" your commission, generating AI images inspired by my artwork, and replicating my artwork using AI.2. If I discover that you actively use or support generative AI to produce images despite being aware that is it unethical, you will be blacklisted from commissioning me, and I will block you on socials. This is non-negotiable, as I am extremely against generative AI.3. I do not consent to my artwork being sold as an NFT, nor do I consent to artworks intentionally inspired by my own artworks being sold as an NFT.4. Commission payment is to be sent via PayPal, through goods and services only. I will send you a money request, which will have the total in CAD (Canadian dollars). It is your responsibility to be aware of the CAD conversion to your own currency.5. Do not pay me until I send the money request. If you go ahead and send money without permission, it will be considered a donation and you will not be refunded. Payment is to be sent after I complete the sketch; not upfront.
Tips are appreciated, but never required!6. Turnaround time for one drawing can be up to six (6) months, though that is the maximum estimate. The average TAT is one week to two months. I get art block easily, so please be patient. You may ask for updates no more than once per every 48 hours. Do not harass me more than that. I will always send you WIPs at different stages (sketch, lines, flat color, shading, background (if applicable.))7. My commissions do not come with commercial rights. You may not sell the artwork, including selling it on prints, clothing, stickers, etc. You may print it for personal use only (a print for your own wall, a t-shirt for yourself, etc.)8. You are responsible for keeping the digital file/image stored safely on your own device. I cannot guarantee that I will have the file in my own storage forever, and in the event we both lose access, I cannot help you.9. Do not ask/commission a different artist to finish/edit my work. You may make small edits yourself. Small edits include, but aren't limited to: background color, adding pride flags, putting a gradient/color filter over the artwork, or drawing on a marking that I may have forgotten on your character's design. You may make your own judgment on what is considered a "small edit"; I am typically flexible with what I allow. However, I may take action (blocking or blacklisting) if I believe the edit was too major and/or disrespectful.10. You may never, under any circumstances, demand a refund. I will only give out refunds when I feel I can no longer complete the artwork, for any reason I provide. 50% of the amount paid will be refunded if I have started the commission; 100% will be refunded if I have not started. By commissioning, you automatically agree that it is non-refundable.11. First I will make the sketch, then I will send it to you (watermarked.) You may tell me to change anything you wish. After you have approved the sketch, you will send the full payment before I start the line art. I will not change the finished line art, so be careful what you tell me during the sketch! The sketch is the only stage where the drawing's pose, expression, or anatomy can be changed.12. In my commission form, you will be asked a question: "What's the special number?" The answer is: 26. This is to be sure you read these terms.13. If you do not specify certain things, such as background color or facial expression, then I will decide them myself. I may not remember to ask you about specifics; it is your responsibility to be specific.14. Credit me properly wherever you may post the commission, including in social media bios if my artwork is used as your profile picture.15. I will automatically post your commission to my social media pages (primarily Artfol, possibly Instagram.) If you do not want your commission posted, tell me before the piece is finished and I will keep your artwork private.16. I may use your commission as an example on my commission art examples Carrd page. Unlike rule #15, this rule is not negotiable; by commissioning me, you automatically agree to this possibility.17. I only accept commissions when the character has an unshaded, flat-color reference image. I will not draw your character based on description alone, no matter how detailed your description may be. If the reference sheet is drawn traditionally, you must understand that the colors may not be the same when drawn with digital tools.18. I will draw a character that doesn't belong to you (example: a friend's character, your sibling's character), as long as you know the owner personally and can provide proof of that claim, such as being mutuals on social media.19. I will only take orders of one (1) artwork at a time per person. This is to reduce burnout. Once your commission is complete, you may request another.20. I have the right to refuse any commission for any reason, as well as to not have to specify that reason. You are in understanding of this the moment you contact me.By commissioning me, you automatically agree to these terms.These terms are subject to change at any time.
